A booking becomes valid only after written confirmation by MAXICAR and full or agreed advance payment. Unless otherwise agreed in writing, all bookings are NON-REFUNDABLE and no-show bookings are fully chargeable. Price includes transport from agreed pickup to drop-off location only. Additional stops or route deviations may incur extra charges.
3. Private Transfer Terms
Flight monitoring & waiting: For airport pickups, MAXICAR monitors flight status if accurate flight details are provided. Up to 60 minutes free waiting time is included from official landing time. After 60 minutes, waiting time may be charged additionally. In case of delays exceeding 3 hours, MAXICAR reserves the right to reschedule or adjust the service subject to operational availability. If no flight details are provided, waiting time is calculated from the scheduled pickup time.
Non-airport pickups: 15 minutes free waiting time applies; after that, additional waiting charges may apply.
Border crossing: The Client is solely responsible for holding valid travel documents. MAXICAR is not responsible if entry is denied by border authorities. If a passenger is denied entry, the full transfer fee remains payable.
4. Shared Transfer Terms
Shared transfers operate on fixed schedules and shared capacity. Maximum waiting time is 15 minutes from scheduled pickup time. Drivers are not obligated to wait for delayed passengers. In case of delay, the booking may be marked as NO-SHOW and is non-refundable. Flight monitoring and extended waiting time are not guaranteed for shared services. For international shared routes, each passenger is individually responsible for valid travel documents. If a passenger is denied entry or detained at the border, the transfer will continue without obligation to wait. No refund will be issued in such cases.
5. Passenger Responsibility & Prohibited Items
Passengers are strictly prohibited from transporting illegal substances, weapons, prohibited or restricted goods, undeclared cash exceeding legal limits, or any items forbidden under Montenegrin or international law. If authorities detain, inspect, delay, or seize the vehicle due to passenger actions, the passenger bears full responsibility and MAXICAR may claim compensation for vehicle downtime, operational losses, legal costs, and related damages.
6. Luggage & Capacity
Clients must accurately declare number of passengers, luggage quantity, and special equipment (ski gear, pets, oversized items). MAXICAR reserves the right to refuse service if safety regulations would be violated due to incorrect information.
7. No-Show Policy
A booking is considered NO-SHOW if the passenger fails to appear within waiting time, cannot be contacted, or incorrect pickup information was provided. In such cases 100% of the transfer fee is charged and no refund is issued.
8. Conduct & Safety
Passengers must wear seat belts, follow driver instructions, avoid unsafe or illegal behavior, and not damage or contaminate the vehicle. The driver may terminate the service if passenger behavior threatens safety. No refund will be provided.
9. Force Majeure
MAXICAR shall not be liable for delays or service failure caused by circumstances beyond reasonable control, including traffic congestion, road accidents, weather conditions, government restrictions, border delays, police controls, strikes, or natural disasters. MAXICAR is not responsible for missed flights, hotel check-ins, business losses, or indirect damages arising from such events.
10. Limitation of Liability
MAXICAR's total liability is strictly limited to the transfer fee paid. MAXICAR shall not be liable for missed connections, border refusal, documentation problems, indirect or consequential damages, or passenger personal belongings (unless caused by gross negligence).
11. Right to Refuse or Terminate Service
MAXICAR reserves the right to refuse or immediately terminate service if the passenger violates these Terms, illegal conduct is suspected, false booking information was provided, or passenger behavior endangers safety. No refund will be granted in such cases.
12. Governing Law & Jurisdiction
These Terms are governed by the laws of Montenegro. Any dispute shall fall under the exclusive jurisdiction of the competent courts of Podgorica, Montenegro.
13. Final Provision
If any provision of these Terms is deemed invalid, the remaining provisions remain fully enforceable. By confirming a booking, the Client acknowledges having read, understood, and accepted these Terms & Conditions.
