RENT A CAR TERMS

MAXICAR

IMPORTANT: MAXICAR operates an online booking platform (marketplace) connecting customers with independent car rental companies in Montenegro. MAXICAR is not a car rental company and does not own or operate the vehicles listed on the platform. The rental contract is concluded directly between the Renter and the rental company supplying the vehicle ("the Rental Company"), and MAXICAR is not a party to it.

These Terms describe the general conditions that commonly apply to rentals booked through the platform. Each Rental Company applies its own rental agreement, its own tariffs and its own conditions, and these differ between suppliers. The binding document is the rental agreement signed directly with the Rental Company at vehicle handover; in case of any discrepancy, that agreement prevails. 2. Eligibility Requirements
The Renter and any additional driver must: be at least 21 years old (or higher depending on vehicle category), hold a valid driver's license for minimum 2 years, present a valid passport or national ID, and provide a valid credit or debit card for deposit. The Rental Company reserves the right to refuse rental at its discretion.

3. Rental Period
The rental period begins and ends at the time specified in the Rental Agreement. A delay exceeding 60 minutes without prior notice may result in additional daily rental charge, repossess of the vehicle, or reporting to relevant authorities. Early return does not automatically entitle the Renter to a refund unless agreed in writing.

4. Deposit and Payments
A security deposit is required before vehicle delivery. The deposit amount depends on vehicle category and insurance selection, and is set, collected, held and released by the Rental Company. The Rental Company may retain part or all of the deposit in case of damage not covered by insurance, traffic fines, missing fuel, cleaning costs due to excessive dirt, or administrative penalties. MAXICAR does not hold or release security deposits. Rental charges must be settled as agreed with the Rental Company.

5. Insurance and Liability
All vehicles include mandatory third-party liability insurance in accordance with Montenegro law. Optional coverage (CDW, Super CDW, Full Coverage) may reduce the renter's liability but does not cover: driving under influence of alcohol or drugs, unauthorized driver, intentional damage, off-road driving, driving without valid documents, interior damage, or tire, rim, clutch, and undercarriage damage (unless separately covered). In case of accident, the Renter must immediately inform the Rental Company using the emergency number in the rental agreement, call the police and obtain official accident report, and not admit liability without official documentation. Failure to provide police documentation may result in full financial liability.

6. Cross-Border Use
Vehicles may not be taken outside Montenegro without prior written approval. Cross-border use within the Balkans requires written authorization, additional insurance, and payment of cross-border fee. Unauthorized border crossing voids insurance coverage and results in full liability.

7. Prohibited Use
The vehicle may not be used for racing, testing, or competitions; for illegal activities; for sub-rental; for transporting hazardous materials; for driving on unpaved or off-road terrain; or by unauthorized drivers. Violation results in immediate contract termination and full damage liability.

8. Fuel Policy
Vehicles are delivered with specified fuel level. The vehicle must be returned with the same level. Otherwise, fuel difference plus service charge will be applied.

9. Traffic Fines and Violations
The Renter is fully responsible for all traffic fines, parking penalties, toll violations, and speed camera penalties. The Rental Company may charge administrative handling fees and is obliged to provide renter details to the authorities.

10. Vehicle Condition
The Renter confirms receipt of the vehicle in good condition unless stated otherwise. Any new damage detected upon return will be charged according to the official damage assessment.

11. Breakdown and Roadside Assistance
In case of mechanical failure the Renter must immediately contact the Rental Company and follow its instructions. Unauthorized repairs may not be reimbursed.

12. GPS Tracking & Asset Protection
For security and asset protection, rental vehicles may be equipped with GPS tracking by the Rental Company. By signing the Rental Agreement, the Renter acknowledges and consents to vehicle location tracking for theft prevention, contract compliance, and recovery in case of misuse or non-return. Tampering with tracking systems constitutes severe contract violation and may result in criminal reporting.

13. Winter Equipment
During the legally defined winter period in Montenegro and neighboring Balkan countries, the Renter is responsible for complying with mandatory winter equipment regulations. If the vehicle is delivered with winter tires or chains, they must not be removed.

14. Force Majeure
Neither MAXICAR nor the Rental Company shall be held liable for failure to perform obligations due to events beyond reasonable control, including natural disasters, war, government restrictions, border closures, strikes, or pandemic-related restrictions. In such cases reservations may be cancelled or modified without liability for indirect damages.

15. Termination & Repossession
The Rental Company may repossess the vehicle without prior notice if the contract is violated, payment obligations are not fulfilled, the vehicle is misused, or false information is provided. All related costs, including recovery and legal expenses, shall be borne by the Renter. MAXICAR does not carry out or authorise vehicle repossession.

16. Complaints, Governing Law & Jurisdiction
Any dispute concerning the rental itself — including damage, deposits, charges or vehicle condition — arises under the rental agreement between the Renter and the Rental Company and must be raised directly with that company. MAXICAR is not a party to that contract and has no authority to determine or settle such claims, though it may pass a complaint on to the supplier as a voluntary service. Montenegrin law applies, and disputes fall under the jurisdiction of the competent courts of Podgorica, Montenegro.

17. Final Clause
If any provision is deemed invalid, the remaining provisions remain fully enforceable. These Terms are read together with the rental agreement signed with the Rental Company, which prevails in case of discrepancy.
